Privacy Policy of the Website

Pursuant to Art. 13 sections 1-2 and Art. 14 of Regulation of the European Parliament and the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the “GDPR”), we would like to advise that:

Joint controllers of personal data

The joint controllers of your personal data are the companies listed in the appendix hereto. As part of the co-administration agreement, the joint administrators established that you can exercise your rights by sending an inquiry or request to any of the Joint Controllers.

In situations when you did not give consent to the processing of personal data for the purpose of participation in future recruitment, the Data Controller shall be the sole Controller of your personal data. The Data Controller is one of the companies listed in the appendix that carries out the recruitment process.

The purpose and grounds of the processing

– In order to carry out the recruitment process, pursuant to Art. 22(1) of the Polish Labor Code and in regard to: first name and surname, parents’ names, date of birth, place of residence, correspondence address, education and previous employment (legal basis: Art. 6 section 1 letter c of the GDPR).
– Based on a consent, processing of personal data other than listed above, provided in the resume, form, the cover letter and other documents (legal basis: Art. 6 section 1 letter a of the GDPR).
– In order to implement the justified interest of the Joint Controllers within the scope of verification of the skills and abilities required for the job (legal basis: Art. section 1 letter f of the GDPR).
– In case of a legal need to prove facts and performance of obligations (legal basis: Art. 6 section 1 letter f of the GDPR).
– For the purpose of future recruitment (legal basis: Art. 6 section 1 letter a of the GDPR).
– For the purpose of direct marketing of the Joint Controllers’ products and services.

Rights of the data subjects

– Right to demand access to one’s personal data and copies thereof.
– Right to demand rectification, removal or restriction of processing of personal data.
– Right to transfer the personal data.
– Right to object to the data processing.
– Right to file a complaint to the Head of the Polish Personal Data Protection Office.

Data retention period

– The data can be stored for the period necessary to carry out the recruitment process.
– The data can be stored for the period of limitation of claims arising from regulations of law.
– The data can be stored for the period of 2 years from the date of consent or until such consent is revoked.

Data recipients

The data can be transferred to competent institutions and processing entities that provide services in favor of the Joint Controllers.

Automated decision-making

We do not make decisions in an automated manner, including in the form of profiling.

Consent and revocation of consent

The right to revoke the consent to personal data processing at any time without affecting the lawful nature of the processing prior to the revocation.

Transfer of data to third countries

The data can be transferred to recipients in third countries (outside EU) due to the Joint Controllers’ cooperation with business partners.

1. The controller of your data is EWL Global Services sp. z o.o. or one of the companies affiliated personally or by capital with EWL Global Services sp. z o.o. listed in the appendix hereto that will start a cooperation with you.

2. Your personal data shall be processed under the GDPR for the purpose of:

a) implementation and performance of the contract concluded with you pursuant to Art. 6 section 1 letter b) of the GDPR or undertaking action in response to your request for conclusion of a contract, in accordance with the legal basis specified above,

b) performance of duties imposed on the Controller of personal data pursuant to Art. 6 section 1 letter c) of the GDPR within the scope provided for in special regulations,

c) performance of the legally justified interests realized by the Data Controller pursuant to Art. 6 section 1 letter f) of the GDPR, namely:

i. implementation and performance of the contract concluded with your employer, principal, collaborator,

ii. in order to determine, defend against or pursue possible claims,

iii. in order to protect persons and property of the Data Controller, including the surveillance system,

iv. to allow the Data Controller carry out direct marketing for the Data Controller’s goods and services,

v. to perform contracts with other Contractors, Customers, for the purposes of complaint procedures,

vi. to carry out audits, inspections,

vii. to carry out communication with the Data Controller.

3. In certain situations, the Data Controller shall have the right to transfer your personal data to other recipients, if it is necessary in order to achieve the objective of the processing, e.g., to persons authorized by the Data Controller that must have access to personal data in order to perform their duties, to processing entities entrusted with personal data processing, or to other data recipients such as, for instance, potential employers, banks, insurance providers, law firms, state authorities, service providers.

4. Your personal data can be transferred to recipients in third countries (outside EU) in relation to the Data Controller’s cooperation with business partners seated outside the EEA and provision of services in favor of the Data Controller in scope of IT and infrastructure.

5. Should you not be the person who provided the Data Controller with your personal data, the data were provided by your employer, principal, or collaborator.

6. Your personal data processed for purposes specified in;

a) point 2 a) will be stored for the period of: endeavors prior to the conclusion, duration or performance of the contract concluded with you, no longer than up to the limitation of claims,

b) point 2 b) will be stored for the period provided for in special regulations,

c) point 2 c) will be stored for the period:

i. of the duration and performance of the contract concluded with you, your employer, principal, collaborator,

ii. needed to ensure protection of persons or property belonging to the Data Controller,

iii. obligatory for the determination, protection against and pursuit of claims,

iv. required by the Data Controller to conduct direct marketing of the Data Controller’s goods and services,

v. needed to perform contracts with Contractors, Customers, implementation of the complaint procedures,

vi. needed to carry out audits, inspections,

vii. needed for the contact with the Data Controller,

– whereby for a period not longer than until the limitation of claims.

7. You shall have the right to request access to your personal data from the Data Controller, demand rectification, removal, restriction of the processing or transfer thereof. The said right can be exercised in person, in writing, via e-mail or by phone.

8. You shall have the right to file an objection to the scope of the processing specified in point 2 c) with regard to the personal data processing for the purpose of the legally justified interest realized by the Data Controller, whereby the right of objection shall not apply in case of important, legally justified grounds for the processing that override your interests, rights and freedoms, particularly with regard to the determination, pursuit of or protection against claims. The said right can be exercised in person, in writing, via e-mail or by phone.

9. With regard to the Data Officer’s actions, you shall have the right to file a complaint to the Polish Head of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw.

10. Provision of the personal data referred to in:

a) point 2 a) is voluntary but constitutes a contractual requirement and is necessary to conclude and perform the contract concluded with you or undertake endeavors to conclude the contract, whereby failure to provide personal data will prevent the conclusion or performance of the contract,

b) point 2 b) is obligatory and constitutes a statutory obligation; failure to provide the data will prevent the conclusion or performance of the contract,

c) point 2 c):

– point i) including: iii), v), vi), vii) is voluntary but constitutes a legal obligation and is necessary for the conclusion or performance of the contract concluded with your employer, collaborator or principal or to undertake endeavors to conclude or perform the contract, whereby failure to provide personal data will prevent the conclusion or performance of the contract,
– point ii) is voluntary and does not constitute a contractual or statutory obligation but will prevent you from access to the Data Controller’s premises,
– point iv) is entirely voluntary and does not constitute a contractual or statutory obligation and you shall not be obligated to provide personal data for this purpose,
– point vii) is entirely voluntary and does not constitute a contractual or statutory obligation but failure to provide such data will prevent contact with the Data Controller.

1. You shall not be subject to activities involving automated decision-making, including related profiling.

Processing – the operations or set of operations performed on the personal data or personal data sets in an automated or non-automated manner, such as data collection, preservation, organization, structuring, storage, adaptation or modification, downloading, browsing, use, disclosure through transmission, distribution or other forms of dissemination, matching or combination, restriction, removal or destruction;

2. The objectives, legal grounds and periods of personal data processing

The objectives, legal grounds and periods of the processing of your personal data by the Data Controller are varied depending on the process the processing takes place in, namely, among others:

a) use of the chat – to handle the inquiries sent to us through the chat, pursuant to Art. 6 section 1 letter a) of the GDPR,

b) in relation to the recruitment, the accommodation process – for the needs of your recruitment process carried out by the Data Controller and providing you with a place of residence (Art. 6 section 1 letter b) of the GDPR),

c) in connection to the legalization of the stay or employment – for the purposes of the proceedings within the scope of legalization of the stay or employment (Art. 6 section 1 letter b) and letter c) of the GDPR),

d) in relation to employment – for the purposes of the implementation of your contract of employment or civil law agreement (Art. 6 section 1 letter b) of the GDPR),

e) in relation to direct marketing – for marketing and advertising purposes (Art. 6 section 1 letter a) of the GDPR),

f) in relation to participation in events and contests – for the participation in such campaigns (Art. 6 section 1 letter a) of the GDPR),

g) in relation to the use of the website and its features – in order to manage and run the website as well as allow its use, including by means of cookie files (Art. 6 section 1 letter f) of the GDPR),

The data are processed pursuant to Art. 6 section 1 letter b) of the GDPR – the processing is necessary for the conclusion and performance of a contract and Art. 6 section 1 letter f) of the GDPR – the realization of the legally justified interests of the Data Controller involving analyses of Users’ activity and preferences in order to enhance the used features and provided services. The Data Controller shall process the data for a period necessary to provide the service and then for a period related to the pursuit of and protection against claims.

2.2. Recruitment, employment, accommodation

The purpose of the personal data processing is to send offers and receive data from candidates for the needs of recruitment proceedings carried out by the Data Controller. Moreover, the purpose is to implement and perform the already concluded contracts of employment or civil law agreements and find a place of residence and provide you with support for the time of your accommodation. The data are processed pursuant to Art. 6 section 1 letter b) of the GDPR – the processing is necessary for the conclusion and performance of a contract; upon the request of the data subject – undertaking action prior to the conclusion of the contract. In case of conclusion of a contract, personal data shall be processed for the duration of the contract and then for the period of limitation of claims arising from the contract. In case of contracts of employment, the data shall be stored for 10 years.

2.3. Legalization of the stay and employment

The Data Controller shall process the data in order to carry out and support you during the process of legalization of the stay and employment. The data are processed for the purposes of performance of the contract with you under Art. 6 section 1 letter b) of the GDPR or in order to fulfil the legal obligation arising from commonly applicable regulations under Art. 6 section 1 letter c) of the GDPR. The data shall be stored for 5 years from the completion of the process.

2.7. Contests, campaigns

The Data Controller shall process data for the purpose of ongoing contests / promotional campaigns, including: choosing the winners, awarding and giving out the prices, granting and giving out bonuses. Data processing shall take place pursuant to Art. 6 section 1 letter b of the GDPR – the processing is necessary for the conclusion and performance of a contract; upon the request of the data subject – to undertake action prior to the conclusion. The data shall be processed for the duration of the contest/campaign and then for the period of limitation of claims arising from the participation in the contest/campaign.

2.8. Direct marketing of own products and services of the Data Controller with the use of electronic means of communication (e-mail, phone, short text messages)

The Data Controller shall send electronic messages with marketing information for advertising, promotional and marketing purposes connected with the Data Controller’s economic activity. The data processing is carried out based on a consent – Art. 6 section 1 letter a) of the GDPR. The data shall be processed for a maximum period of 2 years from the date on which your data is input into the Data Controller’s database or from the date of the last contact with you, whichever of the dates comes later.

2.9. Determination, pursuit of and protection against claims

The Data Controller shall process your data for the purposes of debt collection, conduction of judicial proceedings, and protection against claims. The processing is carried out pursuant to Art. 6 section 1 letter f) of the GDPR – when the legally justified interest of the Data Controller requires pursuit of or protection against claims. The data shall be processed for a period of limitation of the claims, in accordance with the generally applicable regulations of law.

3. The use of cookie files and similar technologies

3.1. COOKIE FILES

The Data Controller shall use the so-called service cookies mainly for the purpose of providing the User with services rendered by electronic means and for the improvement of such services. Thus, the Data Controller and other entities providing analytical and statistical services in the Data Controller’s favor use cookie files, storing information or getting access to information already stored on the User’s telecommunications device (personal computer, mobile phone, tablet, etc.). The Data Controller uses the Google Analytics web service that collects information on website traffic, e.g. the sub-pages that you visited, the time you spent on the website or time before moving to another sub-page. The Data Controller uses the Bitrix24 marketing tool provided by the company Bitrix, Inc. (address of the main headquarters: 901 N. Pitt St, Suite 325 Alexandria VA 22314, USA) which collects details allowing for the identification of a specific person according to the voluntarily provided categories. The data are stored inside the European Union (Frankfurt, Germany) in Amazon Web Services data centers that are fully compliant with the GDPR. 3.7. BAZO.IO

The Data Controller uses the BAZO.IO tool provided by the company Bazo sp. z o.o. seated in Lublin (Poland) in connection with the use of the product called BAZO.IO – in order to collect the following information about your visits to the Website: the dates and frequency of your visits on the Website, the IP address of your device, tabs visited as part of visits to the Website, contact details. The Data Controller uses a tool called Hotjar that is provided by Hotjar Limited, Level 2, St Julian’s Business Centre, 3, Elia Zammit Street, St Julian’s STJ 1000, Malta – in order to analyze your behavior, the Website stores information such as: the dates and frequency of your visits on the Website, the IP address of your device, tabs visited as part of visits to the Website, contact details. The Data Controller processes personal data of the Users who visit the Data Controller’s profiles run on social networking sites (Linkedin, Facebook). Such data are processed solely in relation to the traffic on the profile in order to inform the Data Controller on Users’ activity as well as to promote various types of events, services and products. The legal basis for the personal data processing by the Data Controller for such purposes is the Data Controller’s justified interest (Art. 6 section 1 letter f of the GDPR) involving promotion of their own brand.

5. CATEGORIES OF THE PROCESSED PERSONAL DATA

The Data Controller processes the following categories of Personal Data of the persons contacting the Data Controller or persons that the Data Controller contacts through the chat:

1) identification details (in particular: first name and surname, date of birth, PESEL (Personal ID number), NIP (Tax Identification Number), nationality, details regarding education, employment, experience, likeness) and address details (correspondence address, place of residence),

2) contact details (e-mail, phone number),

3) information obtained during the use of our website, particularly IP addresses, text files,

4) other data you provided in any form – required for the purpose that they were provided for.

6. SOURCES OF OBTAINED DATA

All data are obtained by the Data Controller in the following manner:

1) information provided voluntarily and directly by the users (e.g. through the features of the chat);

2) information obtained during the use of our website, in particular: IP address, text files.

7. DATA RECIPIENTS

The Data Controller can disclose or entrust your personal data to:

1) other entities of the EWL Group,

2) entities providing services to the Data Controller, such as, e.g., accounting, HR, recruitment, legal, debt collection, IT or infrastructure services, whereby such entities process the data as sub-contractors, based on an agreement with the Data Controller and solely according to the Data Controller’s instructions,

3) entities providing postal and courier services,

4) banks.

The Data Controller shall reserve the right to disclose selected information about you to relevant authorities or third parties that request such information, based on adequate legal grounds and according to the applicable regulations of law.

8. VOLUNTARY NATURE OF DATA

Personal data are provided voluntarily. However, if you refuse to provide them, the use of the features of the website will be impossible, among others, in the scope of consideration of inquiries filed through the chat.

The lack of consent to cookie files or revocation of such consent might lead to limited functionality of the website.

9. RIGHTS OF DATA SUBJECTS

Due to the processing of your data by the Data Controller, you shall have the right to:

1) access the contents of your data, demand rectification, removal or restriction of processing thereof;

10. DATA PROCESSING OUTSIDE THE EU

Your personal data can be transferred outside the European Economic Area (which covers the European Union, Norway, Liechtenstein, and Iceland) (hereinafter referred to as: the EEA) in relation to the Data Controller’s cooperation with business partners seated outside the EEA (Ukraine) and provision of IT and infrastructure services in favor of the Data Controller. In order to ensure the adequate level of protection of data transferred outside the EEA, the Company adds standard contractual clauses issued by the European Commission pursuant to Art. 46 section 2 letter c of the GDPR in contracts with the recipients.

11. SAFETY OF PERSONAL DATA

The Data Controller carries out risk analyses on an ongoing basis in order to ensure that the personal data are processed by the Data Controller in a secure manner – ensuring, above all, that the access to the data is given solely to authorized persons and only in the scope necessary for their carried-out duties. The Data Controller shall ensure that all operations on personal data are recorded and carried out solely by authorized employees and partners.

The Data Controller shall undertake the necessary action so that their sub-contractors and other cooperating entities will guarantee the use of proper safety measures in the case of all data processed upon the Data Controller’s order.

Your personal data can be subjected to automated data processing, including profiling.
